Illinois
House Bill 4864 would amend the school code, unless the federal government formally disapproves the policy, such that only schools who have had the same subgroup fail the same subject two years in a row, be deemed "in need of improvement."

New Jersey
Assembly Bill 1699 directs New Jersey school officials to prioritize resources, especially to resolve conflicts between the state and federal education program. In instances where the state program and the federal NCLB law conflict, first priority is to be given to meeting state goals, objectives, program needs and accountability systems, second priority is to be given to meeting federal requirements.
